Get Paid!

Your time and labor are valuable. We trade our time, skill set, and experience for money. However, sometimes it can be a fight to get paid for all of your and your staff’s hard work after a big project.

If you aren’t getting paid for your services as a contractor, you could be able to get money from the state slush fund. You just have to follow these steps:

  • Complete Application for Payment - If a question doesn’t apply to your situation, indicate with an NA. Don’t leave any question blank or you could find your claim delayed or outright denied.

  • Submit evidence that the residence is owner-occupied - there are three different ways to go about this, but you only need ONE. You can submit:

  • Evidence that you have attempted to collect unpaid wages - there are two ways to show this. You can either have a:

    • Copy of a wage claim assignment filed with the Employment Standards of Bureau of the Antidiscrimination & Labor Division of the Labor Commission of Utah - make sure you have copies of ALL supporting documents that were submitted with this claim

    • Copy of a civil action filed by you against them to recover wages owed

  • Submit evidence that shows that you were an employee, you are entitled to the wages that have not been paid, and the total amount of wages due - you MUST have at least ONE of the following:

    • Copy of final administrative order for payment issued by the Employment of Standards Bureau of the Antidiscrimination and Labor Commission of Utah.

    • Copy of a civil judgment in favor of you (claimant) against them.

  • Submit evidence that you have served this application to the non-paying party - to do this you have to complete a Certificate of Service (Page 11), then send the non-paying party a copy of the Certificate of Service and a copy of the application via certified mail with a return receipt requested. Attach the Certificate of Service to the original application.

  • Submit a $15 non-refundable application processing fee - make the check payable to DOPL-LRF

If you are looking for reimbursement there are some things that you should keep in mind.

  • For attorney fees - the judgment must award a sum-certain amount for attorney’s fees

  • For costs - must submit documentation of the amount and nature of the costs. Keep in mind that costs are limited to those costs awardable in district court
